Massachusetts Criminal Code 272 § 35. Unnatural and lascivious acts outlaws "any unnatural and lascivious act with another person" and provides upon successful prosecution a punishment by a fine of not less than one hundred not more than one thousand dollars or imprisonment in the state prison for not more than five years or in jail of the house of correction for not more than two and one half years.
The phrase "unnatural and lascivious acts" was deemed unconstitutionally vague as applied to acts of fellatio and oral-anal contact. ([Balthazar v. Superior Court of Com. of Mass. (C.A.1978) 573 F.2d 698])
It is uncertain if a similar complaint could be successfully made against 272 § 34 for being unconstitutionally vague in its phrasing intending to punish the "abominable and detestible crime against nature".
