Mississippi's Sodomy Law

Mississippi defines "unnatural intercourse" as "the detestable and abominable crime against nature committed with mankind or with a beast" and establishes a penalty of imprisonment for not more than ten years upon a successful conviction.

Oral sex is punishable under the "unnatural intercourse" statute.

Penetration is essential to establish the defintion of sodomy. Oral sex with a woman in which her sexual organs were sucked did not establish penetration and there for the offense of sodomy was not committed. [State v. Hill, 1937, 179 Miss. 732, 176 So. 719]

Sexual devices "designed or marketed as useful primarily for the srimulation of human genital organs" are unlawful by § 97-29-105 Distribution or wholesale distribution of unlawful sexual devices and is punishable by, on the first conviction by a fine of not more than five thousand dollars ($5,000.00) or imprisonment not to exceed six (6) months, or on subsequent conviction, by a fine of not less than two thousand five hundred dollars ($2,500.00) nor more than ten thousand dollars ($10,000) or imprisonment for a term not to exceed one (1) year, or both.
