After Lawrence v. Texas (2003), private consensual adult sodomy is not a live federal-constitutional crime in the United States. What remains in some codes is theater with a prosecutorial trapdoor.
As of 2025 roundups, twelve states still printed the old offence: Florida, Georgia, Kansas, Kentucky, Louisiana, Massachusetts, Michigan, Mississippi, North Carolina, Oklahoma, South Carolina, and Texas — including, in Texas, the very section the Supreme Court struck. Justice Thomas’s Dobbs concurrence, inviting a revisit of Lawrence, is why people who can read a statute book got interested in repeal again.
